  1. Scope 1.1 These General Terms and Conditions (hereinafter referred to as "GTC") of Sarah Weise, trading as "Cutting Corners Design" (hereinafter referred to as "Seller"), apply to all contracts for the delivery of goods concluded between a consumer or entrepreneur (hereinafter referred to as "Customer") and the Seller regarding the goods displayed in the Seller's online shop. The inclusion of the Customer's own terms and conditions is hereby rejected, unless otherwise agreed. 1.2 These GTC apply accordingly to contracts for the delivery of goods displayed in the Seller's print catalog, unless explicitly stated otherwise. 1.3 These GTC apply accordingly to contracts for the delivery of digital content, unless explicitly stated otherwise. 1.4 A consumer, within the meaning of these GTC, is any natural person entering into a legal transaction predominantly for purposes that are neither commercial nor related to their independent professional activity. An entrepreneur, within the meaning of these GTC, is a natural or legal person or a legally responsible partnership entering into a legal transaction within the scope of their commercial or independent professional activities. 1.5 Digital content, within the meaning of these GTC, refers to all data produced and provided by the Seller in digital form, not delivered on a physical data carrier, and supplied under specific usage rights as described in these GTC.

  2. Conclusion of Contract 2.1 Product descriptions in the Seller’s online shop do not constitute binding offers from the Seller but enable the Customer to submit a binding offer. 2.2 Customers may submit their offer through the online order form integrated into the Seller's online shop. After placing selected items into the virtual shopping cart and completing the electronic ordering process, Customers submit a legally binding offer by clicking the button finalizing the order process. 2.3 Customers ordering items from the Seller’s print catalog may submit their offers via telephone, fax, email, or postal mail. To do this, Customers may complete and return the order form included with the catalog. 2.4 The Seller can accept the Customer’s offer within five days:

  • by sending an order confirmation in written or textual form (fax or email), with the decisive date being when the confirmation is received by the Customer,

  • by delivering the ordered goods to the Customer, with the decisive date being the receipt of goods by the Customer,

  • by requesting payment from the Customer after placing the order. If several alternatives occur, the contract is concluded at the point when one of these occurs first. If the Seller does not accept within the specified period, the Customer’s offer is deemed rejected, freeing the Customer from their offer. 2.5 If choosing "PayPal Express," payment processing will occur through PayPal (Europe) S.à r.l. et Cie, S.C.A., subject to PayPal’s terms (https://www.paypal.com/de/webapps/mpp/ua/useragreement-full or https://www.paypal.com/de/webapps/mpp/ua/privacywax-full if paying without an account). In this case, the contract is concluded when the Customer initiates payment by clicking the order finalization button. 2.6 The contract text is stored by the Seller after contract conclusion and sent to the Customer in text form (email, fax, letter). The Seller does not provide other access. If the Customer creates an account, they can access order data in their password-protected area. 2.7 Before placing a binding order, Customers should carefully check inputs. A browser zoom function may aid in identifying input errors, which can be corrected with typical keyboard and mouse functions before finalizing the order. 2.8 German is the only language available for contract conclusion. 2.9 Order processing and communication typically occur via email and automated processes. Customers must provide a valid email address to receive Seller emails, ensuring deliverability (including checking spam filters).

  1. Right of Withdrawal 3.1 Consumers generally have a right of withdrawal. 3.2 Further information about the right of withdrawal is available in the Seller's cancellation policy.

  2. Prices and Payment Terms 4.1 Unless stated otherwise, prices include statutory VAT. Additional shipping costs are listed separately. 4.2 For deliveries outside the European Union, additional costs (e.g., bank fees, customs duties) may arise and must be borne by the Customer. 4.3 Payment options are listed in the online shop. 4.4 PayPal payments are processed by PayPal (Europe) S.à r.l. et Cie, S.C.A., subject to their terms.

  3. Delivery and Shipping Terms 5.1 Unless agreed otherwise, delivery is to the Customer’s specified address. 5.2 If the transport company returns goods due to delivery failure, the Customer bears costs unless not responsible or exercising a withdrawal right. 5.3 Risk transfers to entrepreneurs upon dispatch; for consumers, upon delivery. Risk also transfers to consumers at dispatch if they independently commission the transport company without the Seller’s previous recommendation. 5.4 The Seller may withdraw from the contract in case of improper self-delivery through no fault of their own. Customers are informed immediately, and payments are refunded. 5.5 Self-collection is not possible. 5.6 Digital content is delivered electronically (download or email).

  4. Granting Rights of Use for Digital Content 6.1 Unless stated otherwise, digital content is granted non-exclusive, geographically and temporally unlimited use solely for private purposes. 6.2 Content may not be transferred or copied for third parties without explicit consent. 6.3 Rights are granted after full payment, although preliminary usage permission may be given without rights transfer.

  5. Retention of Title 7.1 Goods remain Seller’s property until fully paid. 7.2 For ongoing business, goods remain Seller’s property until all claims are fully settled. 7.3 Entrepreneurs may resell goods subject to retention of title but assign claims against third parties to the Seller in advance.

  6. Liability for Defects (Warranty) Statutory defect liability applies. For entrepreneurs:

  • Seller chooses type of remedy.

  • New goods defect liability expires after one year.

  • Used goods have no defect liability. Exceptions apply for fraud or construction use. Consumers should report transport damage immediately but retain statutory rights regardless.

  1. Liability Seller liability includes intent, gross negligence, injury to life, limb, health, guaranteed promises, and mandatory legal liabilities. For breaches of essential contractual obligations due to negligence, liability is limited to typical foreseeable damage.

  2. Promotional Vouchers Promotional vouchers are redeemable only within specified periods, by consumers, in the online shop, and not refundable or combinable unless otherwise stated.

  3. Code of Conduct Seller adheres to "Fairness in Trade" conditions (http://www.fairness-im-handel.de/teilnahmebedingungen/).

  4. Alternative Dispute Resolution EU Commission provides online dispute resolution at https://ec.europa.eu/consumers/odr. The Seller is not obligated but generally willing to engage in dispute resolution proceedings.
